Ogiek Elder Murdered |

The latest victim in the continuing communal conflict in Mt. Elgon area is former Chief Tenderesi Temoi aged 83 years. A senior Ogiek elder, Mr. Temoi was kidnapped metres away from the local provincial administrators office in Kopsiro Dision, Mt. Elgon district. He had met with the provincial administrator early that morning.
The kidnappers, alleged to be members of the outlawed Sabaot Land Defence Force (SLDF) are believed to have been monitoring the movement of the elder and suspected he might have given secret information to the provincial administrator.
It is alledge that Mr. Temoi was tortured and had his throat slit, killing him instantly. He body was found minutes after the brutal murder by group of people fleeing the escalating tensions.
Mr Temoi leaves 4 widows, 30 children and over 100 grand children.

In a letter to the President of the UN General Assembly, the GlobalIndigenous Caucus present at the 6th Session of UNPFII has categorically rejected the Africa Group of States proposed Amendments to the Declaration. The African Group proposes to delete the concept of self determination and subject the rights to land and territories to national control among other fundamental changes to the document. UN Declaration on the Rights of Indigenous Peoples |

Hunter Gatherer representives from East and Central Africa have been actively lobbying African Governments to support the UN Declaration. The representatives, who also are part of IPACC's Exco have been in New york a week before the start of the UN Parmenent Forum on Indigenous Isues. Good news from Kenya. |

The Government of Kenya has entered into a loan agreement with the World Bank and therein recognizes that the Sengwer and the Ogiek are Indigenous Peoples. I the document, it actually undertakes to rehabilitate previously displaced forest communities. This is a binding agreement that will be useful if the two communities use it to pressure the Government to restore land rights.

Ogiek in Mt. Elgon suffering |

The more than five thousand Ogiek in Mt. Elgon area in Kenya are going without food and shelter after violent tribal clashes with the majority Saboat community. So far, 11 have been killed, schools have been closed and families are spending the night in the cold. They are urgently appealing for food, warm clothing and pressure on the government to intervene in the land dispute in Chepyuk Settlemnt scheme.

UNEP's 24th Governing Council Meeting/Global Ministerial Forum |

In the on going meeting, UNEP has in principal commited to the formulation of Indigenous Peoples policy but subject to the approval of the governing council. Indigenous peoples representatives at the meeting have started lobbying their governments to agree on such policy. However, since most Africa governments are yet to be comfortable with the idea of indigenous peoples, we need to move slowly as we lobby our governments on the same.
UNEP is also coming up with a website on indigenous peoples! |

The Constitutional court seating in Lobatse, Botswana, on December 13th 2006 delivered the judgment in favor of the Bushmen. The Bushmen who are commonly referred as the Gana and the Gwi broke into joy as the government as the aggrieved party was issued with six weeks to appeal. Approximately a thousand people had attended the court judgment that took eight hours to be delivered |

Policy Processes in Kenya |

2007 will be a very busy year for HUGAFO. The Government is spearheading the formulation of new Land, Wildlfe, Human Rights and the Protecion of Traditional Knowledge Systems, Folklore and Genetic Resources policies. The Proposed Land Policy is already in a draft form and is being discussed widely.
A new Wildlife Policy is also being formulated in consultations with various stakeholders. A major borne of contention is whether to allow hunting of wild life. Unfortunately, Hunter Gatherer communitiers are yet to fully be heard in both of these processes. However, in the formulation of a policy aimed at the Protection of Traditional Knowlerdge, Folklore and Genetic Resources, members of HUGAFO are involved from the very initial stages.

UN Special Rapporteur Visit to Hunter - Gatherer communities |

In his recent trip to Kenya, Prof Radolfo Stavenhagen met with Ogiek, Sengwer, Elmolo leaders and actually visited Ogiek and Yiaku territories. The visit was very successful and the communities raised many issues affecting the enjoyment of their human rights. This included lack of recognition, denial and lack of access to land nd basic services among others. In his farewell speech, the UN special Rapporteur highlighted the many human rights abuses being visited on Indigenous Peoples in Kenya and directed all UN agencies to mainstream indigenous issues in their programs. During the visit, the Government of Kenya assumed a controversial position that ''everybody in Kenya is Indigenous''. However, Prof. Stavenhagen explained at length the criteria for indentifying indigenous peoples. |
